Legal Question in Wills and Trusts in Michigan

Our mother recently passed and she was meticulous regarding her assets. The home is paid off and a sisters name is listed on the home. Her savings included a Met-life policy with 5 children listed as beneficiaries. She also left several savings accounts with individual children listed on those accounts. We are a close knit family and have all agreed that the assets should be equally split including the value of the home. Re: the home - It was agreed among all 8 children that the home would be offered at 'market value' to members of the family first with the sale proceeds being split among remaining siblings (if the one sibling decided to keep the home, then her portion of the 'market value' proceeds would be hers to put toward purchase price. Is there a need to probate or seek legal council? Her will simply states that 'all household' items were to be distributed as noted.

If a sisters name is listed on the deed, presumably it can be handled without Probate.

It might be a good idea to have an attorney draft a asset split agreement or problems may occur in the future. Contact me at (313)402-0853 to discuss further.
