Passage of ownership

If auto is in husband's name and he passes away without a will, does the surviving spouse retain ownership automatically or does it have to pass probate?

Any property which is not previously disposed of by will or contract (i.e. life insurance proceeds, pension) must go through probate.

This is precisely the reason that every individual should have an estate plan created.
