Legal Question in Wills and Trusts in Michigan

rights to contents of mother's home

There was a will for my mother, although never probated (she passed Jan. 2004).

Suddenly my mother signs a quit claim deed and gives her home in Ky. to her grand-daughter before she died.

Do we (my sister and I) have ANY rights to the contents of that home?

My niece won't even let us walk in the door and will not give us as much as a napkin from our deceased mother and father.

This was a complete shock to me and my sister..and of course, her daughter (my niece) isn't even acknowledging we exist!

Re: rights to contents of mother's home

You probably have claim to the contents/personalty unless your mother disposed of the contents to your niece prior to her death. I would take the position that the personal property is the estates and put the responsibility on the niece to prove otherwise. You will still need to open a probate estate to do this. You will have to be appointed personal representative. For more info, please contact my office at (248)851-3171.
