Rules of a Lawsuit?

Suit filed against me, that person is now having legal problems. Can he file my suit away and come back to it at a later time?

A person cannot file a suit and then do nothing. The court either upon your motion or upon the court's own motion would dismiss the case for no action.

A person can file a suit and then withdrawal or dismiss it only to later file it again if the dismissal is without prejudice.
