Legal Question in Wills and Trusts in Michigan

Wife died, in-laws want much stuff from house..

Sirs - My wife of 15 years died at 41 of breast cancer. No will. I have already given the in-laws all personal things I wished them to have. They want more. Do they have any legal right to take things from my house without a will?? They are calling me constantly, and showing up at my doorstep, uninvited. They are threatening to sue.

You have a right to be free from harassment and theft in your own home... ask them not to call or come over... you should open an estate if need be to engage in a process to resolve these issues for your in laws- if they steal something from you call the police, itemize your belongings and contact your insurer.

Your wife's stuff is personal property. As the surviving spouse of a woman who died without a will, you get the first $150,000 and then the rest is divided with the children, if any. Therefore, don't worry about the relatives. William S. Stern
