Legal Question in Wills and Trusts in Michigan

Is there a will?

I live in Arizona and by Father lived in Michigan. Is there a way to find out if my Father left a will when he passed away this past March?

Re: Is there a will?

If your father created a will, he may have filed it with the probate court in the county where he lived, before he died--this is unlikely, and is not very common these days. OR, someone could have found the will and presented it to the probate court already--again, unlikely, given that you are his son (the probate court would have contacted you). The more likely scenario, given that you have not been contacted by the court, is that perhaps your father left no will, or else if there is a will, it's in a safe deposit box or someone amongst his possessions, etc. In that case, it should be located by digging around and looking for it.

Thus, you can do two things:

1) write to the probate court in the county where your father died, asking if there is record of it;

2) come to Michigan to look for the will (or have someone do it).

Good luck,
