Legal Question in Workers Comp in Michigan

IME negligence

I just received a letter from comp stating that my claim is in dispute after my visit to their IME. However, the doctor didn't even have any of my images before the date of the dispute letter. I don't receive compensation from comp because I found another job that is within my restrictions. However, I just want to get fixed so I'm not in constant pain - my treating doc suspects SIJ. I know I have to hire an attorney, but is this even legal?

Re: IME negligence

The treatment of you by the comp carrier is not only legal, but common. they send you to one of their doctors knowing the opinion before you ever walk in the door. They also know that since weekly benefits are not an issue, that you are going to be hard pressed to get a lawyer because there is no way for the lawyer to get paid. As Yaacov Smirnoff used to say, "What a country"! William S. Stern
