Legal Question in Family Law in Minnesota

My husband and I are separating, but have not filed. He refuses to move out. I bought the house before we were married and it is in my name. What are my options?

Hello. You definitely have a multitude of options available to you. What would be best for your situation depends on your unique set of facts. In my professional opinion, if you are considering a separation or divorce it is definitely wise privately to confer with an attorney. In my work experience, I would discuss in great detail with you what are your issues and your needs, and then go over the range of realistic options. In the event that one path of action seems most prudent, then I would state that to you. I always want my clients to know that I respect that this is their personal life and the client should go at her/his own pace. This form of attorney work is sometimes referred to as 'pre-divorce planning'. I recommend that you know several attorneys in choosing one, because it is very important that you feel comfortable and a sense of great trust. I recommend you look at the attorney's biography/resume on her/his webpage, too, to get an idea of her/his background and experience. All the best to you. Tricia Dwyer, Esq. at www.dwyerlawfirm.net

You must have a court determine who should have residency of the home pending a final divorce or legal separation. As a result, you must commence a divorce or legal separation action. As part of that action, you may file a Motion for Temporary relief seeking an Order that determines who pays what bills, who resides in the home, who drives what car, whether any support is paid while the case is pending and before it is final.
