Enforcability of pricing on "Estimate"

We recently had our roof replaced. We got an estimate prior to authorizing the work to be done. Now, the contractor is trying to bill us for more than the original estimate. Can they do that? Isn't the estimate enforcible? The final price is 20% higher than the original estimate.

It depends on all of the circumstances. Not only do the terms of a written contract have to be carefully reviewed, but also the oral representations of the contractor at the time of the original contract and thereafter. Also, the state law where the contract was entered into as well as where the building is also will apply to your question.

I suggest you consult with an attorney where either you live or in the town where the building is located for a better analysis of the law which would apply to this situation.

The answer to your questions depends largely on the contract you signed. If the contract allows for a deviation from the estimate, it may still be a valifd charge. Most contracts contain such a clause. Moreover, many contracts also indicate that the contrator will inform you in advance of any overages.
