Legal Question in Criminal Law in Minnesota

multiple criminal conviction?

Dear Sir/Madam,

I was arrested for two counts of threatening and sentenced to one day on both counts and 18 months probation. Would you please tell me is this multiple criminal conviction?

Thank you for your time.

Re: multiple criminal conviction?

It is not possible to say with any certainty given your description. If you plead guilty to two counts, you would have a conviction record for two separate charges.

Re: multiple criminal conviction?

Your question does not provide enough information to answer the question properly.

Under Minnesota law, a person normally cannot be sentenced twice for the same behavioral conduct, same date, same behavior, same victim, etc. Therefore, it is likely that either you were sentenced erroneously, or the two crimes were not based upon the "same behavioral incident." If you were sentenced incorrectly, it is important to request relief to the sentencing court, and-or the appellate courts before your rights are lost or diminished by the passage of time. Time is of the essence. Consult a lawyer in person as soon as possible, by providing that lawyer adequate information about your situation.
