Legal Question in Criminal Law in Minnesota

small possession of marijuanna

I got a citation for a small amount of marijuanna, and intent to buy. What can I expect? This is my first offense.

Thank You,

Al

Re: small possession of marijuanna

Minnesota Statute Section 152.027, subd. 4 makes "possession of small amounts of marijuana" a "petty misdemeanor" -- maximum fine of $300, but is not a crime under Minnesota law, is not an arrestable offense, and carries no jail time. A "small amount of marijuana" in Minnesota is defined by statute as "42.5 grams" (approximately 1.49 ounces) However, interestingly, a small amount of marijuana can be a crime in Minnesota under most circumstances if in a motor vehicle.

Your mention of "intent to buy" is too vague to comment on. You can call me if you wish, to discuss it. Perhaps there is more information on the citation, clarifying that. Maybe it is a reference to a city ordinance, or a notation by the cop unrelated to a specific criminal charge?
