Vandalism

Son being accused of vandalizing a new home development behind our home. Should I have an attorney present for a statement?

He should not be making a statement to anyone including law enforcement. In their interview, they are only looking for inculpatory information. They are not seeking information to exonerate him.

He would be far better off hiring counsel and to perform any investigation privately.

Yes. But normally a good lawyer would advise him not to speak to police or others about alleged wrongdoing. Better to have lawyer do own investigation, privately.

Do not make a statement without an attorney present. Police officers not only have methods of soliciting incriminating statements, but are notorious for lying in the police report. Once they gather the evidence they need, they will press charges.
