Legal Question in DUI Law in Minnesota

4th Degree DUI

I was charged with a 4th degree DUI (boating while intoxicated) by Blood achohol level was .08. The deal the prosecuter game me was move to a careless and probation for a year, Then it is off my record. my questions is since it is a recreactional vehicle and my first offense can this effect my driving record ?

Your driving record will be marked with a notation that you had an impaired incident, but your driving privileges will not be affected THIS time around. If you have any future impaired driving incidents in ANY kind of vehicle for the next ten years (car, boat, ATV, snowmobile, etc.) then this incident will come back to haunt you by increasing the penalties for you on the new offense.

It is not removed from your record. Instead, your record will show that you were charged with a BWI and it was amended with a plea to a careless boating. This remeans on your record indefinitely.

On a first offense for a BWI, even if not reduced to a careless, your license would not be revoked. On a second offense within ten years, it would be.
