Legal Question in DUI Law in Minnesota

DUIs in WI count in MN

I have two DUIs in the about 7 years ago in WI and I was told about the strict DUI laws in MN. I dont do it anymore anyway, but I want to know if I were to get one in Mn would it be considered my 3rd offense or my 1st?

It would be considered your third offense in ten years, and the state would seize your car - or the car you were driving at the time even if it is not yours.

One thing I keep seeing in situations like yours is that the person with two priors always seems to be driving someone else's car - and that's the car that gets taken by the state.

This is not the way to keep your friends, marriage or girlfriend. It really pisses people off when their car is gone for good and it's your fault. The state doesn't care if it's a beater or a mercedes. It's gone.

Be careful.

Legally, the state can use prior offense from other states, but there are some obstacles for them to overcome. If you had a MN license at the time you got those priors, and if your MN license was revoked, it's pretty easy for the state to use those offenses and they will most likely count toward your new offense. If you did not have a MN license at the time, then a good defense attorney can bring defenses to the table that might convince the state to back off. Your best bet is to call a cab -- it's a lot cheaper than my fee!
