Legal Question in DUI Law in Minnesota

my son was arrested on the 12 of sept. for dwi. he was held in jail for 2 days then released. he has not got a ticket or been charged with anything as of nov.12. is there a limit of time the state has to make a charge

The last time I checked the statute of limitations was three years. That should be how long they have.
