Legal Question in DUI Law in Minnesota

probation violation

I'm a resident of South Dakota since Aug of 2007. I left Minnesota on a travel permit on that date, and was on probation for dui 3rd. I recieved another dui 3rd in South Dakota in Sept of 2007, and was sentanced to 6 mo in jail, a 4 year susp prison sentance, and 4 yrs probation. I now have a non-extraditable warrent for prob violation in Minnesota. I need access to the Elsworth Air Force Base to remain employed. I cannot do that with a warrant from another State. I spoke to the probation office in Minnesota, and they said that the only way I can take care of it is to return to Minnesota and turn myself in. My SD probation officer says that is not a good idea. I have a great job, which are very difficult to come by here, is there any other option that you know of that I may pursue to get rid of the warrant even if I pay my past due fines and court costs?

Re: probation violation

Your question would require some investigation before I could say much for sure. It reminds me of a case I had in the last year where I represented a Souix Falls SD resident concerning a warrant he had for not appearing in court for a Minnesota DWI back in the 1990s.

In that case I was able to talk the prosecutor here into letting my client appear by means of written documents, enter a plea without coming here (like Senator Craig did), and just pay a fine. That cleared my client's record so that he could get on with his career.

If you would care to contact me, I would be glad to discuss the possibilities.
