Re: Probation violation

A probation violation can carry any number of consequences. Unlike the burden of proof required to convict an individual (proof beyond a reasonable doubt), a probation violation need only be proven by clear and convincing evidence. This burden is rigid, but not impossible for the State to overcome.

The possible sentence depends largely on 1: whether the State can prove you violated your probation, 2: what sentence you had suspended while being placed on probation.

The bottom line: You should consult with an attorney before going to court on your own.

My office provides free consultations and would happy to assist you.

Thanks for the question.

Re: Probation violation

There is no "usual" sentence. It depends on the seriouness of the underlying charge, the particular Judge that did the sentencing and the nature of the violation.

Without an attorney, consequences can be significant.
