Legal Question in Family Law in Minnesota

My ex is $2500 behind in spousal support. He now says he is only willing to pay me what he has left to pay according to our divorce agreement, which is $4000. He says he will pay me $2000 this month and $2000 next month and that's it and I have to sign a paper saying I agree to that. I am in desperate need of money but I can't afford to forgo the $2500 he still owes me. If I agree to this and sign a paper, can I still take him to court for the rest? I need to pay my rent so I need SOMETHING from him now. Thanks.

Hello. If you are considering signing a legal document, you ought to confer with a private attorney who will review the document and advise you on your rights, and pros and cons, trade-offs, legal consequences, etc.

This website provides general information and general principles of law and does not provide private legal advice. Some attorneys are available seven days for emergency legal needs. Many attorneys will confer initially at no charge. Then, if legal work is performed, some attorneys will provide a reduced fee for financial hardship. Some attorneys may also assist you in limited scope manner to conserve legal costs. All the best.

First off, you don't "have" to sign a paper to agree to anything. Second, whatever you're ordered to receive in the decree controls. Your ex cannot unilaterally change it. If he doesn't pay you, you may motion for contempt which would provide legal consequences for failure to follow the court order.
