Legal Question in Family Law in Minnesota

Adoption

My now ex-wife would like for her new husband to be able to adopt my daughter. We have all talked about this and have come to agreement on the adoption. My ex-wife and her new husband have been together since 2000, however, have only been married since 04-24-04. I have been told that in MN a step-parent adoption cannot ordinarily occur until after the step-parent and natural parent have been married for at least one year. However, I have also been told that since all parties are in agreement, that her lawyer will petition the court for early consideration. Is this normally a problem or have you seen this go through when all parties are in agreement, and, the new husband and the now ex-wife have been together since 2000? Any answers will be of great help.

If all parties are in agreement, there is likely to be no problem. Step parent adoptions are treated significantly different than other types of adoptions.
