can I change my sons' last name to mine without the fathers consent

Hello. I presume you are referring to a minor. The general rule is that notice of your legal action seeking to change the name of the child must be made or attempted to be made in the manner prescribed by Minnesota law. There are exceptions to the rule and those exceptions are decided by a judge or referee.
