I was married 9 years ago, my ex wife has just told me at ''we'' had a child born 6 months after I left. now she wants child support. Would I expect to pay any backpayments since I never even knew this shild was born. And she is saying I'm the ''legal fater'', she has started with the paperwork I have been mailed papers from child support. What if I'm not the biological dad??? help please..

Don't sign anything. Don't agree to anything. Make sure to tell the County repeatedly that you want a blood test before you will pay anything. Also, call me. I offer a free initial consultation if you want to come in and visit for an hour at no charge. I have gotten people out of owing any back support in these types of situations.

Re: child suport

If you were divorced before the child was born, it is unlikely that you are the presumed father under law. As a result, your ex would be required to commence a paternity action before child support could be awarded. You may seek blood testing to determine paternity at that point.

If the child proves to be yours, you may be required to pay back child support for up to two years. However, that is a negotiable issue and you have several equitable arguments that such an award should not occur.
