Child Support in MN

I have been paying child support for almost 10 years. Recently, I got a notice from Dakota County (where my child support order is) that I or the obligee can request a modification if we want to. I know that MN law now takes into account nonjoint children (I have one and the obligee also has one now) and we only have 1 joint child. I also see my son, every other weekend, alternating holidays and Wednesday over night, meaning I shoudl qualify for the parenting time credit too right? I am concerned if I ask the County to look into it they might raise it instead. The Obligee chooses not to work, would they actually input potential income like they claim they would do? Or how I can I find out who much the obligee makes if she refuses to tell me? The caculator on the DHS website is no use if you don't know what the other person makes or how to compute 'potential income.' Please advise.

It is always wise to run a calculation of suport before filng any motion.. You may request the other parenties tax return to determine income pursuant to Minnesota Statutes.

You may wish to retain an attorney to make the request for the finacnial records and to calculate support before filing a Motion.

Most of the time income is imputed to an unemployed parent, however, that is not a guarantee. Factors to consider when calculating potential income include the parent's education, former employment and pay rate, and work history.
