Legal Question in Family Law in Minnesota

custody between two states

The father has custody and lives in CA and the mother gets visitation and lives in MN. During a visit the child told the mother of sexual abuse that has been happening at her home in CA. The mother called socail services and the mother got a temporary order of protection and custody while this is being investigated in MN and CA. Can the mother go for custody in MN even though the original custody hearing was in CA?

Re: custody between two states

The original court that determined custody retains jurisdiction so lo0ng as one parent continues to reside in that state. Any custody proceeding would have to occur in that jurisdiction.
