Legal Question in Family Law in Minnesota

Family Court/Child visitation & Custody

The mother of my child will not permit me to visit or gain temporary custody of my child, she has not attended any of the hearings for child support OR Custody. I need to know how I can Force her to abide by the visitation order or (if posible) get permanent custody of my daughter.

Re: Family Court/Child visitation & Custody

I would need to see the court order you currently have, but it sounds like you will need to serve her with an Order to Show Cause (which is an order demanding that she appear in court and explain why she isn't allowing the visits). At that time, you can ask for extra visits to make up for what you lost or even file for a change of custody. If she fails to appear, she would be in violation of the Order to Show Cause and a warrant for her arrest would be issued. Please contact me if you would like to discuss this matter further. We offer a free initial consulation.

If you already have an order, you will have to use the Order to Show Cause procedure to hold her in contempt. You will serve that with your motion for compensatory time and possibly for a change of custody.
