grandparents rights

My 16 year old step-daughter was raped by a 20 year old. She became pregnant. She has custody and the father's rights have been reserved. He has not been convicted yet but is serving time for dwi. What are his mother's rights regarding visitation and how will they change when he's convicted?

Do you mean what are his rights if he is convicted of rape?

There is no easy answer to that question. A court makes custody and parenting timne decisions based on what it determines is in the best interests of the child. Without more facts, it is not an easy thing to analyze. If he is convicted of criminal sexual conduct because he had intercourse against the other person's will, certainly I would not expect a court to allow any parenting time.
