Legal Question in Family Law in Minnesota

Second Parent Adoption

Hello,

I have a question that maybe you could answer. My partner and I, finally decided to have a baby. I would be the one having it, but as far as her name on the birth certificate how would that work? Can we do the second parent adoption while the baby is still unborn, so that right at the hospital her name can be on the birth certificate or do we have to wait until the child is born? Also what is the process in starting the adoption, what are the requirements that we need to have as far as paperwork and what not? Also how much would something like this cost?

Thank you so much!

Angie

Re: Second Parent Adoption

If this is a same sex situation, Minnesota does not allow a same sex adoption I am afraid. The closest you can come is to grant guardianship, but that is revocable at will.

There are no particularly good solutions under Minnsota law at present.
