parental rights

If a dad is in jail and he has a family member watching his kids instead of them going to there moms since they dont like her. can she just take the kids. or should the dad get some legal documents saying something so she cant. if so what documents?

Your question is too complicated for a quick answer. The family member may be able to obtain a custody order under certain circumstances. I am uncomfortable advising the father or family member not to obtain a new custody order under these circumstances without knowing much more about the mother's custodial rights and parenting practices.
