I have sole custody of my daughter. Her father and I were never married and he moved out of state when my daughter was 3 months old. He has paid child support, excluding a recent 9 month glitch, but very rarely makes attempts to contact or visit her. If he filed for joint custody or visitation rights, would they be granted?
Custody and visitation decisions are made based on a Best Interests of the Child Standard. The result often depends on how well the case is argued. A court would certainly allow parenting time, although it may be supervised to start, until the child becomes acclimated to the parent.
