my son had a baby boy with his girlfriend he is now 19 years old and she is 15 years old who has the custodial rights to the child she lives in Minnesota he lives in North Dakota

She is presumed to be the custodial parent under law. Your son has no enforceable rights unless or until he files an action in court to establish custody, parenting time and child support.
