I was unemployed for 6 months and did not know I could get a reduction in child support. Can a person go back and request the amount owed removed if they can show their income was not sufficient for that amount
Child support can only be modified retroactive to the date the other person is served with the Motion. As a result, if you did not yet serve the obligee with a Motion to Modify Child Support while you were unemployed, you will not be able to get your child support reduced for that time period.
Counsel is correct. there can be no retroactive modification of support except back to the date that a Motion is properly filed.
