Daycare provider breeched contract

I signed a contract with my daycare provider the week of September1. The week of October 4 she gave me a new contract to sign with many changes. The original contract stated that I had to give a 2 week notice. Since she broke the original contract and I will not sign the new one am I obligated to give her 2 weeks notice. I thought since she breeched the original contract I was not obligated to the 2 weeks

Based only on the facts that you have given, I would have to say that you are stuck with the two week notice. If you don't sign the amended contract, the original contract remains in effect.

Contract law is a complicated area. I strongly suspect that you may have additional facts which would release you from the contract without the two week notice - but you didn't give any in your question.

It might pay for you to consult a lawyer and go over the whole story. As usual, it is very difficult to do justice to a situation in the small space allowed here.
