If the retainer was based on an hourly rate, the answer depends on whether sufficient time has been spent on the case to exhaust the retainer. If the retainer was a flat fee and non-refundable, it is non-refundable assuming the terms of the retainer agreement was followed.

Generally, a $500 retainer will not take you very far and would most likely have been long exhausted after a year and a half.
