Legal Question in Immigration Law in Minnesota

Hello there,

Im on my 8th year H1.

My I-140 got denied, and we filed an appeal which is denied recently.

I got 9th year extension on the basis of I-140 appeal. My H1 extension is valid till Oct2010.

What are my options?

Can I transfer my H1 to a different company who can file LC or there are no chances of extending my H1 after Oct, 2010.

Thanks,

BA

You have used H-1B for more than 6 years. Extensions were granted on basis of pending I-140 and then appeal. If you want to continue on H-1B, you will need to depart the USA for at least one year, and then have an employer to petition for you again. Or have another employer file the I-140 for you. You don't have to work for another petitioning employer.

Best would be to discuss your options with a qualified attorney in private. Specifically, what are the reason for I-140 denial, etc.
