Legal Question in Insurance Law in Minnesota

Retiree Health Insurance

I recently retired from county government with fully paid health insurance. To my knowledge the county did not have an Employee Retirement Security Act SPD stating this benefit could be changed in the future. I knowThe only documentation of this benefit I am aware of is the union contract and the county peronnel mannual handed out to all employees stating the requirements.

I met all of the requirements to receive this benefit which included 25 years of service and eligible to retire under the Rule of 90.

The county is now trying to present a new plan to the young work force offering free dental, less co-pays, lower premiums but with much higher deductibles. The retirees have been told they have no vote in the matter and that each bargaining unit will be allowed to vote on it.

My husband was dianosed with Ewings Sarcoma over two years ago, and had we not had the coverage I was promised, it would have wiped out our entire retirement saviings. The threat of it returning is still there, so we are very concerned, as are many other retirees. Is what they are attempting to do legal, and do we have any recourse to fight this? I can understand them wanting to change, but are current retirees protected against this change?
