Legal Question in Juvenile Dependency in Minnesota

Juvenile Punishment

I have a 16 year old son that was picked up by the police as a runaway. When they went to arrest him, he tried to run and a police office was slightly injured. He is being charged with fourth degree assualt on a police office, giving a false name and a gross misdemenor for not sure what, maybe obstructing legal process. Can you tell me what his punishment might be? This is his first offense.

Could he possible be sent to juvenile jail?

Re: Juvenile Punishment

What the dispostion (punishment) might be depends on lots of variables. With a good attorney representing him, he would probably get some sort of probation. The conditions of probation (again if he gets a good lawyer) would probably be that he apologize to the police officer, go to counseling, and perhaps do a few days of community service or work squad. They have work squads that clean parks and such. He might also be required to attend school regularly and keep passing grades. I've also had cases where part of the deal was that the kid was supposed to get a part time job.

Which brings me to the fine. He might also be required to pay a fine - but that could depend in part on whether he has any money or the ability to get some. A few hundred dollars would be ball park.

Good luck. If counseling is ordered, plan on participating in it.
