Legal Question in Employment Law in Minnesota

Non-compete enforceability

I worked for a company for 7 years and was not required to sign a non-compete agreement. 3 months ago, the company sold the division I worked for to another company that operates in several distinct product markets and I was required to sign a non-compete if I wanted to be employed by them. 3 months after the sale, my position was eliminated. If I obtain a position with a company that competes against my former employer in one of its other divisions (one that I did not work in), is this a violation of the non-compete? I only worked for this company for 3 months and I feel it is unduly interfering with my right to make a living if the non-compete net can be cast that wide.

Re: Non-compete enforceability

Cannot advise without review of the contract language. Non-competition agreements are disfavored in the law, but will be enforced if narrowly drafted and reasonable in terms of geographical location and time limits.

Call or email for further assistance.

I have extensive experience in both defending and attacking non-competes in litigation.
