Legal Question in Employment Law in Minnesota

Wrongful Termination?

I have been employed by the same co. since 6/27/88. I was injured on the job in 1999 and covered by workers comp. I was able to work with limitations until Mar. 03, and have been on medical lv/LTD since 3/14/03. We ''were'' a union co., and at the time I went out, contract gave me 5 yrs. to return. On 8/20/05 Co. Imposed new contract and reduced time limit to 2 yrs. They sent me a letter of Termination eff.. 10/15/05. I'm still on LTD, under Dr. Care (OJI Dr.) and want to know if I have a ''Wrongful Termination'' possible? I'm still facing at least 1 major surgery or more, before I might be able to work again. This case is more complicated than I can fully explain here. I am also past Union rep. and feel this may be part of my situation, but will be hard to prove. The Co. is also in BK now. This involves a Major Air carrier in MSP. I need advice on my rights and any time limits for taking action. If they can Term me, will they have obligation to retrain once/if I am able to work in the future? Thank you in advance. Please feel free to email or call directly. BigDog58 at Gmail.com

Re: Wrongful Termination?

Need more info. Were you in union when terminated? Are you receiving UE comp?

I would need to see your emplyee manual and/or your collective bargaining agreement to advise.

This would be billable at my normal hourly rates.
