Legal Question in Personal Injury in Minnesota

Broken kneecap due to fall on ice

I suffered a broken kneecap injury walking my dogs and slipped on a large sheet of ice in front of the entrance. The paramedics arrived and they or someone else had to call maintenance at my apt. complex to drop alot of salt in order to even get me on the gurney. Also the mgr. admitted via phone that the drainage pipe from the building was dumping on the sidewalk..as well as several residents had previously called to report the ice problems at that particular entrance what options are available?

Re: Broken kneecap due to fall on ice

I agree with Mr. Beaulier's answer. I have some additional information. Slip and fall cases can be hard to prove in Minnesota in the winter; however, there are aspects to your case that indicate that the landlord is responsible and that your case is a winnable one. For example, the EMS having to have salt put down in order to function is an indication of negligence. The landlord stating that a drain pipe is spilling onto the sidewalk is negligent. In my opinion you have a strong case. Please contact me if you want to discuss your case further. I am truly sorry that this has happened to you.

The answer depends on the nature of the injury. If the injury is significant, there may be a viable personal injury clain. If not, it is not likely something that an attorney would tackle simply because of the limitation in damages. You must laways prove negligence, which is not easy on a slip and fall case in Minnesota, You would have to show that there was some notice that the establishment had of a dangerous condition that was ignored.
