Legal Question in Personal Injury in Minnesota

child hurt at school event

My son was at a basketball game and taking down a set of bleachers while a supervisor was watching. The metal bleachers fell on his leg, they did not want to move him, called an ambulance, which was then intercepted by a 2nd ambulance that could administer pain meds, taken to the emergency room for x-rays, the leg was not broken. Now the school is telling us they do not have medical liability insurance and will not take care of the ambulance / hospital charges. Are they liability and how do we get them to take care of these bills?

To prevail in such a case, you must demonstrate that the school breached the accepted standard of care and that, as a result, injury occurred. There seems to be a very good case against hte school for negligent supervision, and maintenance of equipment, among other things. However, that does not mean a resolution will be simple.

If the school refuses to accept liability the matter would have to proceed to court. Whether you can find a lawyer to handles such a matter may well depend on the level of the damages. Obviously, a claim were there is minimal injury would not warrant a significant recovery and, as a result, attorney's fees become impractical.

If you believe the damages are $7,5000 or less, you may wish to file your claim in conciliation court.
