Hurt while goofing around

A friend (and co-worker) of mine and I frequently wrestle with each other at work, on the golf course, etc. We trade a lot of verbal barbs with each other, but all in good fun. This morning we were wrestling and he got his ribs bruised and is in some pain. I don't expect that he would do this, because we're friends, but since I instigated this particular tussle, can he sue me?

Yes.

Many say this is a fundamental problem with our legal system. It is pretty easy to sue anybody for anything.

Other lawyers may disagree with this, but I suggest that you apologize. Profusely. "I'm sorry you were hurt. I really wish that hadn't happened. I don't like seeing you in pain." If you can avoid it don't say things like: "I'm sorry I hurt you. It's all my fault." Take him to lunch. You might even consider buying him a small gift - if you can do it in a way that would not offend him.

I can't count the times that someone came to me wanting to sue someone because they were pissed off because that person did not apologize and acted as if they had no fellings. Being kind is much better than getting sued.

What you say could be used against you, but I think you are less likely to get sued if you make some sort of apology. If the injury sounded more serious, I might suggest silence - but not for something relatively minor like this.
