Legal Question in Product Liability in Minnesota

Injury : Caused by a negligent product, or not?

A 4 year old was severly burned because her mother left her alone

in a store and she stole some matches. Is the company who

makes the matches negligent in their design, strictly liable, or

breaching its warranty of merchantability, the owner of the store

because of his placement of the matches on the front counter, or

the mother because she left her daughter alone?

Re: Injury : Caused by a negligent product, or not?

The mother is the most likely negligent person for leaving a 4 year old alone in a store. A child that age doesn't generally have the knowledge to know about stealing.

I hope this helps. Our office is not representing you on this matter but I would urge you to contact an attorney to discuss the facts further if you additional questions.
