If the buyer in a contract for deed sale dies unexpectantly without a will and with a balance owing and in default, does the seller have the right to resell the house without going through probate?

Assuming that the contract for deed was a matter of public record, it will be a cloud on the title until it is cancelled.

You might have to open a probate file yourself to have someone appointed who can be served with the cancellation notice.
