Legal Question in Real Estate Law in Minnesota

Eviction after Marriage

I am living in Minnesota, and my wife and I were just recently married as of Jan 5, 2001. I have moved into her apartment building with her, and now the landlord is threatening to evict her because i am there. Is a spouse considered to be an un-authorized tenant, and is she in violation of her lease?

Leases are contracts, so it depends a great deal on what the lease says. If the lease provides that only one person is to live there, you may have a problem.

Most landlords are willing to renegotiate lease terms in situations such as yours.

There is a nonprofit organization in Minneapolis which deals with issues like this - the Tenant's Union. Look them up in the phone book and call them. They might have some suggestions.

Good luck.
