Legal Question in Real Estate Law in Minnesota

my home during a divorce

Me and my husband are currently sepperated and I also have an OFP against him, we will also be getting a divorce. At the present time he is living in the house paying the bills and in control. I am unemployed and living with my sister. Now my husband claims to be moving and not going to continue to pay mortgage. I can't afford it what can i do to prevent my credit from going bad or the house to forclose? Is it possible to take my name off house loan? Thanks Renae

Re: my home during a divorce

Under most circumstances, it will not be possible for you to get your name off the loan. If the house is left vacant with nobody paying the mortgage, it will most certainly be foreclosed upon. You can't change that either.

You might want to try filing a bankruptcy. That would be the standard way of getting rid of debts you can't pay. Bankruptcy might be better for your credit that sitting there passively and letting all of these things happen while doing nothing.

Your credit can't be the best in any event if you are unemployed.
