Legal Question in Real Estate Law in Minnesota

personal property

I recently left a relationship and bought my own house and I left some of my personal property behind until I had my house remodeling done. My ex refuses to let me take my items out of the house. Do I have the right to remove my property?

Re: personal property

I would add to the above that there is a spot in the conciliation court complaint to ask for your property back ("replevin"), or the value if it cannot be obtained. If you need to sue I suggest you talk to an attorney about how to structure your complaint.

Re: personal property

If there is no dispute as to who owns the items, then you typically have the right to demand, in writing, retrieval of your personal property within 24 hours of the written demand. If refused, the owner of the premises can be liable for actual and punitive damages and reimbursement of attorneys' fees for enforcement of the demand in court. If the two parties dispute ownership of the personal property items, then this is a more complex claim. You should consult an attorney for further assistance.

Re: personal property

You have no right to entry on the property if you are not listed as the owner or renter. You would have to file a civil suit in District Court to seek "replevin" which is the return of the property or file for the value of the property in concilliation (small claims) court.
