Legal Question in Real Estate Law in Minnesota

Refinance - wife's name not on title or mortgage

We are refinancing - the documents have only my name on the mortgage and say that the title will be held only by me as a 'married man'. Will my wife be forced to payoff, refinance or sell the house in case of my death? Should I insist on her name in the title or mortgage or both? Thanks.

Re: Refinance - wife's name not on title or mortgage

Ifit is a refinance your wife will be required to sign the mortgage, although she does not have to sign the note. Although you may add your wife to title, if you wish, you do not have to. There would be some estate planning issues about doing so.
