Legal Question in Social Security Law in Minnesota

payback disability payments?

My husband has been recieving disability payments from his employer since he became sick 4 years ago. He has finally won his claim for SS disability. Do we have to payback the disability insurance he was paid? He has about $40,000 sitting in savings now. He is still getting payments from ss and private disability. We don't know what to do. Thanks.

Generally, one has to pay back disability carriers if you get social security for the same time period. I say generally because it is dependent on the contract. Also, you may get a guaranteed benefit over and aboce social security, so the pay back may not be the full amount.
