Your DAR is probably a Misdemeanor - max is 90 days or $1,000 or both.

But your second DWI is a gross misdemeanor. The max is $3,000 or one year or both. And there are some mandatory minimums with that - including 30 days of which at least 2 days has to be actual jail time.

You didn't ask what will happen to your license. I guess that's because it's already gone.

You didn't ask about license plates either. I hope you were driving your own vehicle. If it was a friend's vehicle, the friend might have to get whisky plates.

This is a really serious set of circumstances you have. It is not to be taken lightly, and it should not be faced without a lawyer.

If it is your first Driving After Revocation offense, it is a misdemeanor. A misdemeanor is punishable by up to 90 days and a $1,000 fine.

If you are still on probation for the DWI, the DAR would likely constitute a probation violation and the Judge in the DWI case may impose any sentence previously stayed. That likely means you could be sentenced up to 90 days in jail on the probation violation as well.
