Legal Question in Traffic Law in Minnesota

Driving after Cancellation

I am diabetic and need to send in a form every 3 years to be deemed competent to drive. I was late sending the form in, so my license was canceled, but had my doctor send the form in over a week ago, so I thought everything was resolved.

A couple days ago, I was driving and was pulled over. (Officer did not specify why). I received a ticket for driving after cancellation. (Apparently the DMV is behind on mail right now.)

My question is, can I get this this ticket dismissed once my license is valid again, since it was canceled due to a health form, and not committing any type of offense?

Re: Driving after Cancellation

Thank you for your post. Often, a prosecutor will be willing to negotiate where te circumstances are similar to those you describe. With the assistance of counsel, it is quite likely that the ticket may be avoided with a Stay of Prosecution. It certainly helps to negotiate that result with your license reinstated.
