Legal Question in Wills and Trusts in Minnesota

familys leagal rights after death of elderly mom

Our mom passed away Jan 9th 2008,

she was in a nursing home and was

receiving medical assistance thru

Anoka county. There is no will. The

county is sending a lot of legal

documents and we don't know what

our rights are or what they are

wanting from us. Please help.

Chances are that the Department of Human Services has some sort of claim against the estate of your mother for medicaid which she received.

The general rule is that "medicare" comes with no future obligation, but "medicaid" can be a claim against the estate after the person who received it dies. Usually a person who receives care long term in a nursing home eventually winds up on medicaid if they live long enough.
